4Motion Skatepark Privacy Policy

Version: 26.10
Effective date: 26 October 2026 (26/10/26)

4 Motion Darlington (company number 08504871), trading as 4Motion Skatepark Darlington, operates 4Motion Skatepark Darlington and this store and website (together, the "Services"). Our website is powered by Shopify, which enables us to provide the Services to you. This Privacy Policy describes how we collect, use, and disclose your personal information when you visit our skatepark or website, participate in activities, complete a waiver, make a purchase or otherwise communicate with us. If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

This policy explains our use of personal information and your choices. Visiting the park, using the website or signing a participation agreement does not itself give consent to every use of your information.

  • Directly from you including when you create an account, visit or use the Services, communicate with us, or otherwise provide us with your personal information;
  • Automatically through the Services including from your device when you use our products or services or visit our websites, and through the use of cookies and similar technologies;

This may include using your personal information to better tailor and improve the Services.
  • Marketing and Advertising. We use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you online advertisements for products or services on the Services or other websites, including based on items you previously have purchased or added to your cart and other activity on the Services.
  • Security and Fraud Prevention. Our Lawful Bases

For ordinary personal information, we rely on:

  • Contract: processing necessary to provide purchases, bookings or other services requested by the person with whom we contract.
  • Legitimate interests: running and securing the business, responding to enquiries, preventing fraud, managing participation and safety, and handling claims, where those interests are not overridden by your rights. We give particular weight to children’s rights.
  • Legal obligation: processing required by applicable accounting, tax, reporting or other legal duties.
  • Consent: where required for marketing, cookies or other optional uses. Consent can be withdrawn without affecting the lawfulness of earlier processing.

We send promotional emails or texts only where we have the consent required by law or an applicable existing-customer exception, with an opportunity to opt out. You can unsubscribe using the message’s controls or email info@4motiondarlington.co.uk. Service messages about an order or participation may still be sent.

Health information requires an additional special category condition, as explained in the skatepark section below.

How We Disclose Personal Information

In certain circumstances, we may disclose your personal information to third parties for legitimate purposes subject to this Privacy Policy. Such circumstances may include:

  • With Shopify, vendors and other third parties who perform services on our behalf (e.g. IT management, payment processing, data analytics, customer support, cloud storage, fulfilment and shipping).
  • With business and marketing partners to provide marketing services and advertise to you. For example, we use Shopify to support personalised advertising with third-party services based on your online activity with different merchants and websites. Our business and marketing partners will use your information in accordance with their own privacy notices. Depending on where you reside, you may have a right to direct us not to share information about you to show you targeted advertisements and marketing based on your online activity with different merchants and websites. To opt out of these uses or object to this processing, email info@4motiondarlington.co.uk. We will handle requests relating to our own processing and help you contact Shopify or the relevant provider where they are responsible for the processing.
  • When you direct, request us or otherwise consent to our disclosure of certain information to third parties, such as to ship you products or through your use of social media widgets or login integrations.
  • In connection with a business transaction such as a merger or bankruptcy, to comply with any applicable legal obligations (including to respond to subpoenas, search warrants and similar requests), to enforce any applicable terms of service or policies, and to protect or defend the Services, our rights, and the rights of our users or others.

Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services to provide and improve them. Information you submit through the Services is shared with Shopify and relevant service providers, which may be located outside the country where you live.

We have enabled Shopify Network Intelligence. This allows Shopify to use information about your interactions with our store together with information from your interactions with other merchants and Shopify to provide enhanced services, including advertising, personalisation and improvements to Shopify products and services. These uses are subject to applicable consent requirements and privacy choices.

For processing carried out to provide these enhanced services, Shopify acts as an independent controller and is responsible for responding to requests concerning its own use of your information. You can read the Shopify Consumer Privacy Policy to learn more and use the Shopify Privacy Portal to exercise the rights and choices Shopify makes available.

You can also email info@4motiondarlington.co.uk. We will handle requests concerning our own processing and help direct requests concerning Shopify’s independent processing to Shopify. Contacting us is an additional option and does not replace the Shopify Privacy Portal.

Cookies and Privacy Choices

Our website uses cookies and similar technologies to operate the store and, where permitted, support analytics, personalisation and advertising. Some cookies are necessary for functions such as the shopping basket, checkout and security. Where consent is required for other cookies or similar technologies, we ask for it before using them. Simply visiting our website or accepting our participation terms does not give consent to advertising cookies.

We use Shopify’s automated cookie banner, configured to display to visitors in the United Kingdom. You can use the controls presented in the banner to make your choices. You may withdraw consent where processing is based on consent. If you need help changing your choices, email info@4motiondarlington.co.uk. Withdrawal does not affect processing lawfully carried out before you withdrew consent.

Depending on where you live, you may also have rights to opt out of the sale or sharing of personal information or its use for targeted advertising. You can email info@4motiondarlington.co.uk about our processing and use the Shopify Privacy Portal for Shopify’s independent processing.

Third Party Websites and Links

The Services may provide links to websites or other online platforms operated by third parties. If you follow links to sites not affiliated or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such sites, including the accuracy, completeness, or reliability of information found on these sites. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms may also be viewable by other users of the Services and/or users of those third-party platforms without limitation as to its use by us or by a third party. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.

Children’s information

Our skatepark welcomes children aged 5 and over, with younger children permitted during designated toddler sessions. We collect and use relevant children’s information to administer participation, apply age restrictions, record parental permission, manage safety and contact a responsible adult when necessary.

A parent or person with parental responsibility must complete the participation agreement for anyone under 18. Relevant information may include the child’s name and date of birth, parent or guardian details, emergency contact details, participation permissions and the record of acceptance of our terms. The participation agreement is renewed every 12 months; renewal does not automatically mean earlier records are deleted.

Participants under 10 must be accompanied and actively supervised by a responsible adult aged 18 or over. Participants aged 10 to 17 may attend without an accompanying adult where their parent or person with parental responsibility has authorised this and supplied an emergency contact.

We process necessary participation and emergency-contact information for our legitimate interests in operating the skatepark safely and administering participation. We balance those interests against the child’s rights and interests and give particular care to children’s privacy. Where a parent contracts with us, we do not assume that the parent’s contract is a contract with the child.

Children have their own data protection rights. A parent or person with parental responsibility may contact info@4motiondarlington.co.uk about a child’s information. We will consider the child’s understanding, the requester’s authority and the circumstances before disclosing information or acting on a request. Deletion requests remain subject to applicable legal exceptions and justified retention needs.

Signing a participation agreement does not give blanket consent to promotional photography or the processing of health information. The relevant purposes, lawful bases and any additional conditions must be explained separately where applicable.

Skatepark records and other venue information

Participation records and emergency contacts

We use 4 Motion’s bespoke cloud-based system to record participation agreements. We collect the participant’s name, address, date of birth, relevant medical information where supplied, and emergency contact details. Emergency contact details include the contact’s name, telephone number and relationship to the participant. For children, we also record parental permission as described above. Participation agreements are renewed annually.

We use these records to administer participation, check age requirements and permissions, support safe use of the park and contact someone in an emergency. Our lawful bases for ordinary personal information are performance of a contract where the participant is a party to that contract and processing is necessary for it, and our legitimate interests in administering the skatepark and protecting participants. The additional requirements for health information are addressed below.

If you give us someone else’s emergency contact details, please let them know and direct them to this policy. We use their details for emergency contact and related safety purposes.

Medical information

Medical information is special category personal data. We collect relevant information supplied through the participation system to help staff understand participation needs and respond appropriately to an incident. It can be accessed by staff and management. Access is limited to those who need the information for these purposes; please provide only relevant details.

For routine collection, storage and use of medical information supplied for participation support and incident response, we ask for separate explicit consent. This is our lawful basis under Article 6(1)(a) and special category condition under Article 9(2)(a) of the UK GDPR. Where a child cannot give valid consent themselves, we seek it from a person with parental responsibility, taking account of the child’s understanding. We do not treat a general waiver signature as explicit consent to this processing. You can withdraw this consent by emailing info@4motiondarlington.co.uk. We will stop the consent-based processing, although relevant information may still be retained where a separate lawful basis and special category condition apply, such as for necessary legal claims. If withdrawal affects support we can safely provide, we will discuss the practical implications with you. Withdrawal does not affect the lawfulness of earlier processing.

Where necessary to establish, exercise or defend legal claims, we may process relevant health information on the basis of our legitimate interests in handling those claims and the special category condition for legal claims. In a genuine emergency, vital interests may apply to necessary health information where the person is physically or legally incapable of giving consent. This is not our basis for routinely collecting medical details from all participants.

Accidents and first aid

We keep a paper accident book recording names, injury details, treatment given and witness details. It is stored in a locked filing cabinet, with access restricted to management. We use accident records to document incidents, manage follow-up action and deal with relevant insurance matters. Relevant incident information may be shared with our insurer when needed to deal with a claim.

We rely on our legitimate interests in managing safety, investigating incidents and handling claims. Where a specific legal recording or reporting duty applies, we rely on compliance with that obligation. For health information necessary to establish, exercise or defend a legal claim, we also rely on the legal claims condition under Article 9(2)(f). For other routine health information recorded with consent, we seek separate explicit consent. In an emergency involving a person physically or legally incapable of giving consent, necessary processing to protect vital interests may instead apply. We do not assume that every incident automatically falls within these exceptions.

CCTV

CCTV covers the skatepark and car park and records video without sound. Recordings are stored on equipment at the skatepark and can be viewed by staff and management for safety, security, crime prevention and incident investigation. Our lawful basis is our legitimate interests in protecting visitors, staff and property and investigating incidents, balanced against the privacy of those recorded.

Routine footage is normally retained for up to 30 days. Relevant incident footage may be kept longer where needed for an investigation, insurance matter or legal claim, and is deleted when that need ends. Relevant footage may be shared with our insurer in connection with an incident, or with authorities where disclosure is necessary and lawful.

Photography and video

We take photographs and videos in connection with skatepark activities for use on our website, social media and printed advertising to promote the skatepark and its activities. If you do not want yourself or your child included in promotional photography or video, email info@4motiondarlington.co.uk. We pass this preference to staff so that they can act on it. You can also use this address to raise a concern about an existing image, identifying the image or post where possible.

An absence of an objection is not consent. Where a particular use cannot be justified by legitimate interests, we seek appropriate consent before that use or do not use the image. Where we rely on consent, it can be withdrawn by emailing us. We take account of a child’s understanding and the authority of the person giving permission.

We rely on our legitimate interests in promoting our skatepark and activities where these are not overridden by participants’ rights and interests. We give particular weight to children’s privacy. You may object to promotional use of your or your child’s identifiable image by emailing info@4motiondarlington.co.uk. We will stop using it for direct marketing following an objection and take appropriate steps concerning material under our control. We cannot guarantee retrieval of printed material already distributed or copies independently shared by others.

Coaching, holiday clubs, parties and competitions

We also process information to organise coaching, holiday clubs, parties and competitions. Depending on the activity, this may include attendance lists, authorised collection details and competition results. We use relevant information to organise the activity, manage attendance, support safe collection of children and administer competitions.

We rely on performance of a contract where the individual is a party to it and the processing is necessary for it, and our legitimate interests in organising activities safely. Health information remains subject to the additional conditions explained above. Any intended public use of names, results or images must be explained to participants in advance, with an appropriate lawful basis and particular care for children’s privacy.

Cloud storage and access

Participation information is held in our bespoke cloud-based system hosted on Microsoft Azure. Microsoft provides the cloud infrastructure used to store and process this information on our behalf. Authorised cloud hosting and system support providers may process information to operate, maintain and secure the system. This does not give them permission to use medical information for advertising. See International Transfers below for information about overseas processing.

How long skatepark records are kept

We keep personal information only for as long as it is needed for the purpose for which it was collected, taking account of applicable legal requirements and justified insurance or legal-claim needs. Annual renewal of a waiver does not by itself require either deletion or indefinite retention of previous records.

Waivers and accident records are retained for up to seven years to meet the confirmed insurance and record-keeping needs, subject to any necessary extension for an ongoing claim, investigation or applicable legal requirement. The retention period is assessed by reference to the relevant participation or incident, the participant’s age, applicable claim periods, and the duration of any investigation or claim. This is not an automatic seven-year retention period for every item of personal information. Superseded medical information, emergency contacts and attendance or collection details are kept only while needed for current participation, safety or a justified record of an incident. Promotional images are retained while needed for the stated promotional use, subject to objections and withdrawal of consent where applicable. Information no longer needed is securely deleted or anonymised. Routine CCTV footage is normally retained for up to 30 days, with incident-related exceptions as explained above.

Security and Retention of Your Information

Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." In addition, any information you send to us may not be secure while in transit. We recommend that you do not use unsecure channels to communicate sensitive or confidential information to us.

How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, to provide you with Services, comply with legal obligations, resolve disputes or enforce other applicable contracts and policies.

Your Rights and Choices

Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. However, these rights are not absolute, may apply only in certain circumstances and, in certain cases, we may decline your request as permitted by law.

  • Right to Access / Know. You may have a right to request access to personal information that we hold about you.
  • Right to Delete. You may have a right to request that we delete personal information we maintain about you.
  • Right to Correct. You may have a right to request that we correct inaccurate personal information we maintain about you.
  • Right of Portability. You may have a right to receive a copy of the personal information we hold about you and to request that we transfer it to a third party, in certain circumstances and with certain exceptions.
  • Managing Communication Preferences. We may send you promotional emails, and you may opt out of receiving these at any time by using the unsubscribe option displayed in our emails to you. If you opt out, we may still send you non-promotional emails, such as those about your account or orders that you have made.

If you reside in the UK or European Economic Area, and subject to exceptions and limitations provided by local law, you may exercise the following rights in addition to the rights outlined above:

  • Objection to Processing and Restriction of Processing: You may have the right to ask us to stop or restrict our processing of personal information for certain purposes.
  • Withdrawal of Consent: Where we rely on consent to process your personal information, you have the right to withdraw this consent. If you withdraw your consent, this will not affect the lawfulness of any processing based on your consent before its withdrawal.

To exercise your rights, email info@4motiondarlington.co.uk or write to our postal address below. Where your request concerns processing for which Shopify is independently responsible, you can use the Shopify Privacy Portal, or contact us for help directing your request to Shopify.

We will not discriminate against you for exercising any of these rights. We may need to verify your identity before we can process your requests, as permitted or required under applicable law. In accordance with applicable laws, you may designate an authorised agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorised them to act on your behalf, and we may need you to verify your identity directly with us. We will respond to your request in a timely manner as required under applicable law.

Complaints

If you have a complaint about how we handle your personal information, email info@4motiondarlington.co.uk or write to the address below. We will acknowledge your complaint within 30 days, investigate appropriately without undue delay, keep you informed and explain the outcome.

You also have the right to complain to the Information Commissioner’s Office, the UK data protection regulator. Information about making a complaint is available at ico.org.uk/make-a-complaint. If you live elsewhere, you may also have the right to complain to your local data protection authority.

International Transfers

Shopify and other providers may process personal information outside the United Kingdom. Our participation system uses Microsoft Azure; the use of a cloud service does not itself mean that all storage, backups and support access take place in the UK.

Where we make a restricted international transfer, we must ensure that a permitted transfer mechanism applies. Depending on the recipient and destination, this may be UK adequacy regulations or appropriate contractual safeguards, such as the UK International Data Transfer Agreement or the UK Addendum to the European Commission’s Standard Contractual Clauses, together with any required assessment and additional protections. For transfers subject to EU GDPR, the corresponding EU transfer requirements apply.

You can contact info@4motiondarlington.co.uk for details of the overseas processing relevant to your information and to request information about, or a copy of, applicable safeguards, subject to appropriate redactions. Shopify explains its own international processing in its linked privacy policy.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Privacy Policy on this website, update the version and effective date and provide notice as required by applicable law.
